The role:

The Compliance Officer reports to the Conducting Officer and will play a key role within the AIFM Compliance function ensuring that the compliance and AML programs are implemented and carried out and that policies are at all times adequate and up to date with current regulations and group policies. The Compliance Officer will provide advice and will support the business functions in relation to new regulations and launch of products and will also carry out assurance missions as established by the multi-annual compliance monitoring plan (including testing and issuance of recommendations in documented reports)

Compliance

  • Support the Conducting Officer in managing the overall relationship with the CSSF and other regulators, including keeping track of the interaction with the regulators of the AIFM and the AIFs,
  • Ensuring the AIFM's compliance program meets the requirements of AIFMD and other key regulations and ensure that compliance policies and procedures are updated
  • Complete compliance risk assessments as necessary (including quantitative weightings) and update at least annually the Compliance Monitoring Plan. Execute the compliance reviews planned as well as other advisory and assurance reviews as assigned and draft the reports with recommendations. Work in coordination with other internal control functions of the AIFM or the groups
  • Keep track of new regulations and assess the impact on the AIFM and the AIFs as well as
  • Ensuring necessary staff / management training is provided for specific AIFM compliance policies and regulatory issues on an on-going basis
  • Draft the report to the AIFM board, fund boards and management committee on compliance matters
  • Support the onboarding of new activities, new funds and products; document the new product compliance assessments
  • Prepare and submit (Atlas, eDesk) the annual compliance reports
  • Support specific compliance areas in coordination with the group compliance teams and participate in working groups such as complaint management, ESG, GDPR

AML

  • Update, as necessary, the AML policy and the risk appetite and the risk assessment (including weighting calculations) of the AIFM and the funds
  • Support and prepare responses and documentation for queries on the AML program of the AIFM
  • Support the AIFM business functions on the monitoring the activities performed by third-party delegates and administrators (including, without limitation, review of KPIs, due diligence reviews, etc.), ensuring any issues arising are appropriately documented on an on-going basis and escalated where appropriate
  • Support decision making on escalated request for approval of new funds or investors with a higher risk profile
  • Draft the annual AML summary report and the AML questionnaires. Respond GoAML queries and prepare SARs forms for submission if required. Prepare AML reports for the management committee and the board
  • Organize and undertake annual AML training for the AIFM staff including the branches

Required expeirence

  • 3-5 years' experience in a compliance, audit or risk team within a financial entity, audit firm or consulting entity carrying out advisory and assurance missions in financial services. Good knowledge of the Luxembourg and EU regulatory environment
  • With previous exposure to the funds industry, in particular AIFM funds but experience in UCITS will be also considered. Previous experience with MIFID activities (European distribution or brokerage and discretionary portfolio management) will be a plus but is not essential
  • Good command of Excel. Exposure to technology projects and monitoring systems will be valued (like the implementation of compliance-related systems or audit platforms) and with third party reporting systems (MyStateStreet, eFast, Geneva, Investran) and compliance reporting tools (Atlas, eDesk, GoAML).

Education

  • Bachelor's Degree in business administration, law, other relevant professional qualifications
  • Additional education on funds industry, compliance or audit will be highly valued
  • Candidates or fully certified ACAMs or other compliance or relevant financial services certifications (including CAIA, CFA, etc.) will be a plus
